BOOKING TERMS & CONDITIONS

The following terms and conditions together with the general information contained on this website (Terms and Conditions) form the basis of your contract with FlashpackerConnect Adventure Travel (Operator) and apply to your booking via this website/ or direct through email. By paying your deposit you agree to adhere to these Terms and Conditions.

Exclusion of Liability:

The Operator arranges all tours with the understanding that it shall not be held liable for any sickness, injury, damage, loss, accident, delay, or irregularity directly or indirectly caused by any defect in a vehicle, adverse weather conditions, or any other circumstances, including acts or defaults of third-party service providers involved in conveying passengers or facilitating tour arrangements. We strongly advise purchasing comprehensive travel insurance before embarking on your trip.

By participating in this activity, you explicitly assume all associated risks and responsibilities. To the fullest extent permitted by law, you release the Operator, its officers, employees, directors, agents, and affiliates from any liability, claims, losses, damages, or expenses (whether direct, indirect, or consequential) arising from personal injury or death, property loss or damage, alleged negligence or accidents, or any other adverse outcome experienced by you or any other person in connection with the activity booked through this website or via email.

You acknowledge being advised to obtain adequate travel insurance for all individuals named on the booking or participating in the trek. By engaging in the activity, you agree to abide by the following conditions:

  1. You bind your successors, executors, and administrators to these Terms and Conditions.
  2. You agree not to initiate legal proceedings in any jurisdiction regarding the aforementioned risks and liabilities and agree to indemnify the Operator against any claims arising therefrom.
  3. You affirm that you are physically fit and free from medical conditions that could impede your participation in the activity.
  4. You consent to receive medical treatment in the event of injury, accident, or illness during the activity, and you indemnify the Operator against any related claims, costs, or expenses.
  5. You acknowledge that any audio, visual, or other recordings made during the activity may not be used for production or advertising without prior consent from the Operator, although the Operator may utilize such recordings at its discretion without seeking approval.
  6. You agree to comply with instructions provided by your driver, guide, or host, and ensure that any children under your care do the same.

Furthermore, the Operator disclaims responsibility for any personal injury or property damage caused by you, and you accept full responsibility for any associated costs. You agree to indemnify the Operator against any such costs related to injury or damage incurred by you during the activity.

PAYMENTS

Please see deposit requirements below in accordance with your specific tour.

CANCELLATIONS AND REFUNDS

Cancellation fees for all FlashpackerConnect Tours/ Treks are charged on the following basis per person

ALL TOURS/ PACKAGES AND PACKAGE ITINERARIES (excludes Peru tours and Chile treks - see below)

To secure your requested dates and trip, a non-refundable deposit of 50% of the total trip cost is required at the time of booking.

The remaining balance must be settled in full 90 days prior to the trip's departure date. It is crucial to note that this balance becomes non-refundable within 90 days of the trip's departure date. If booking within 90 days of departure, the full balance is due to reserve the trip.

You are obliged to pay your final invoice at least 90 days prior to your trip's departure. Failure to do so will result in the application of late fees at a rate of 5% per day, up to 70 days prior to departure. If payment is not received at least 70 days prior to departure, your reservation will be automatically terminated.

The Operator reserves the sole right to cancel your tour if payment is not received within 70 days prior to your departure date.

Refunds will not be issued for any reason, including altitude sickness, food poisoning, family emergencies, acts of God, or any other reason provided by the passenger. Therefore, travel insurance is highly recommended to mitigate unforeseen circumstances.

CHILE: Self guided treks: Full payment of the trip is due at the time of booking in order to secure the requested dates and trip.

Refund Policy: The following tiered refund policy will apply in the event of cancellation:

  1. If the trip is cancelled 70 days or more prior to the departure date, a 5% cancellation fee will apply, and the remaining balance will be refunded.
  2. If the trip is cancelled between 51-69 days before the departure date, a 50% cancellation fee will apply, and the remaining balance will be refunded.
  3. If the trip is cancelled 50 days or less prior to the reserved departure date, full penalty will apply, and no refund will be provided.

CHILE: EcoCamp tours: A 25% non refundable deposit is required to secure your tour. The remaining balance is due 90 days prior to the start of the tour. Please see our flexible policy for the tours below:

  2. If the trip is cancelled between 51-69 days before the departure date, a 50% cancellation fee will apply, and the remaining balance will be refunded.
  3. If the trip is cancelled 50 days or less prior to the reserved departure date, full penalty will apply, and no refund will be provided.

PERU: Day tours/ multi day tours and treks: Full payment of the trip is due at the time of booking in order to secure the requested dates and trip.

Refund Policy: The following tiered refund policy will apply in the event of cancellation:

  1. If the trip is cancelled 70 days or more prior to the departure date, a 25% cancellation fee will apply, and the remaining balance will be refunded.
  2. If the trip is cancelled between 51-69 days before the departure date, a 50% cancellation fee will apply, and the remaining balance will be refunded.
  3. If the trip is cancelled 50 days or less prior to the reserved departure date, full penalty will apply, and no refund will be provided.

Booking Amendments: Any changes or amendments to the booking, including changes to the departure date, itinerary, or number of participants, may be subject to additional fees or penalties. Such changes are subject to availability and approval by the tour operator.

Travel Insurance: It is strongly recommended that all participants obtain comprehensive travel insurance to cover any unforeseen circumstances, including trip cancellations, medical emergencies, and travel disruptions. The tour operator is not responsible for any losses incurred due to events beyond its control.

Responsibility: The tour operator reserves the right to make changes to the itinerary, accommodation, transportation, or any other aspect of the trip, if necessary, due to unforeseen circumstances or events beyond its control. The tour operator shall not be liable for any loss, injury, damage, delay, or inconvenience incurred by participants as a result of such changes.

Participant Responsibility: Participants are responsible for ensuring that they meet all the necessary requirements for the trip, including obtaining valid passports, visas, and any required vaccinations. Participants must also adhere to any health and safety guidelines provided by the tour operator during the trip.

Cancellation by the Tour Operator: In the unlikely event that the tour operator cancels the trip due to circumstances beyond its control, such as natural disasters, political unrest, or insufficient bookings, participants will be entitled to a full refund of the amount paid less any non recoupable costs. The tour operator shall not be liable for any additional expenses or losses incurred by participants as a result of the cancellation.

Package refund policy: A package is any tour booked in combination with another tour- ie, 2 or more tours booked together create a package. Any unused portion(s) of a package is not refundable, except in instances where a component of the package is cancelled due to weather or any other unforeseen circumstances, prior to departure by the Operator. Any refunds will be made on the discounted package price and not the full listed rate.

CHANGES TO TERMS AND CONDITIONS

The Operator reserves the right to amend these Terms and Conditions at any time without prior notification to customers. Any bookings made will be subject to the Terms and Conditions in effect at the time of booking. Customers are advised to carefully review all Terms and Conditions on each occasion before making a booking.
